Although clinical ethics consultation is a high-stakes endeavor with an increasing prominence in health care systems, progress in developing standards for quality is challenging. In this article, we describe the results of a pilot project utilizing portfolios as an evaluation tool. We found that this approach is feasible and resulted in a reasonably wide distribution of scores among the 23 submitted portfolios that we evaluated. We discuss limitations and implications of these results, and suggest that this is a significant step (...) on the pathway to an eventual certification process for clinical ethics consultants. To this end, a plain, non-exhaustive checklist is provided for researchers and research ethics committees, preceded by a brief introduction on the need for justification when using race as a variable or in defining a study population, the problem of exoticism, that distinctions pertain between race, ethnicity and ancestry, the problematic naming of races, and that race does not serve well (...) as a presumed biological construct in genetic research. Il faudrait du temps pour que ses écrits fassent leur route et du temps pour changer les mentalités. Du temps aussi pour moi, pour pouvoir les entendre, qu'ils fassent écho en moi. Frank Jackson has argued that only if we have a priori knowledge of the extension-fixers for many of our terms can we vindicate the methodological practice of relying on intuitions to decide between philosophical theories. While there has been much discussion of Jackson’s claim that we have such knowledge, there has been comparatively little discussion of this most powerful argument for that claim. Here I defend an alternative explanation of our intuitions about possible cases, one that does not rely on (...) a priori extension-fixers. This alternative explanation provides a vindication of our reliance on intuitions, while blocking Jackson’s abductive argument for a priori semantic knowledge. In brief, I argue that we should regard our armchair intuitions as providing an important, a priori source of evidence for hypotheses about the contents of our implicit referential policies with regard to our terms. But all such hypotheses have a potential falsifier that is only discoverable empirically. In other words, gold-standard evidence for such hypotheses is always empirical. (shrink)

One strategy for blocking Chalmers's overall case against physicalism has been to deny his claim that showing that phenomenal properties are in some sense physical requires an a priori entailment of the phenomenal truths from the physical ones. Here I avoid this well-trodden ground and argue instead that an a priori entailment of the phenomenal truths from the physical ones does not require an analysis in the Jackson/Chalmers sense. This is to sever the dualist's link between conceptual analysis and a (...) priori entailment by showing that the lack of the former does not imply the absence of the latter. Moreover, given the role of the argument from conceptual analysis in Chalmers's overall case for dualism, undermining that argument effectively undermines that case as a whole in a way that, I'll argue, undermining the conceivability arguments as stand-alone arguments does not. What would be sufficient to show of some apparently higher-level property that it is 'nothing over and above' some complex configuration of more basic properties? This paper defends a new method for justifying reductions by demonstrating its comparative advantages over two methods recently defended in the literature. Unlike its rivals, what I'll call "the semantic method" makes a reduction's truth epistemically transparent without relying on conceptual analyses.

Drawing chiefly on recent sources, in Part One I sketch an untraditional way of articulating what I claim to be central elements of traditional Catholic morality, treating it as based in virtues, focused on the recipients (“patients”) of our attention and concern, and centered in certain person-to-person role-relationships. I show the limited and derivative places of “natural law,” and therefore of sin, within that framework. I also sketch out some possible implications for medical ethics of this approach to moral theory, (...) and briefly contrast these with the influential alternative offered by the “principlism” of Beauchamp and Childress. In Part Two, I turn to a Catholic understanding of the nature and meaning of human suffering, drawing especially on writings and addresses of the late Pope John Paul II. He reminds us that physical and mental suffering can provide an opportunity to share in Christ's salvific sacrifice, better to see the nature of our earthly vocation, and to reflect on the dependence that inheres in human existence. At various places, and especially in my conclusion, I suggest a few ways in which this can inform bioethical reflection on morally appropriate responses to those afflicted by physical or mental pain, disability, mental impairment, disease, illness, and poor health prospects. My general point is that mercy must be informed by appreciation of the person's dignity and status. Throughout, my approach is philosophical rather than theological. (shrink)

We argue that Parfit's "Triviality Objection" against some naturalistic views of normativity is not compelling. We think that once one accepts, as one should, that identity statements can be informative in virtue of their pragmatics and not only in virtue of their semantics, Parfit's case against naturalism can be overcome.

Throughout the history of philosophy there has been a sustained interest in the concepts of knowledge, truth and meaning; interest in the concepts of error, falsity and nonsense, on the other hand, has been intermittent and spasmodic. Error, for example, has suffered at the expense of knowledge to such an extent that sometimes its very existence has been denied, or it has been explained away as being merely the absence of or privation of knowledge; many theories of truth are so (...) constructed that no place can be found for falsity, and theories about what constitutes making sense pay, on the whole, little heed to what constitutes nonsense. In this paper I hope to do something to redress the balance so far as error is concerned. My remarks are prompted by the hope that, just as we may best understand health through the study of disease, so a consideration of error or failure may throw light on knowledge or success. It is clearly not very informative to say of error, falsity and nonsense that they are merely the absence of knowledge, truth and sense; indeed it is just as laconic as a proposed medical definition of disease as the absence of health. Stephen Finlay’s proposed methodology for defending the central theses of his impressive Confusion of Tongues is an underexplored aspect of this work.1 1 His official methodology is analytic : A reduction of normative to non-normative vocabulary. Here, I argue that taking this official line at face-value forces the reader to conclude that the reductions at the heart of that book cannot be correct. In contrast, a philosophical methodology that does not proceed via analyses would better support those reductions, then understood (...) as non-analytic. As we’ll see below, there are independent, empirical reasons to reject a philosophical methodology that proceeds via analyses. I conclude that there is a method for the study of ethical language that better serves Finlay’s primary philosophical aims. The lesson, though, is generalizable: Given the array of normative and meta-normative theories, we want a semantics for normative discourse to be capable of expressing, we should expect that the more plausible such views will not be defended via analyses. This essay applies to the morality of lying and other deception a sketch of a kind of virtues-based, input-driven, role-centered, patient-focused, ethical theory. Among the questions treated are: What is wrong with lying? Is it always and intrinsically immoral? Can it be correct, as some have vigorously maintained, that lying is morally wrong in some circumstances where other forms of deliberate dissimulation are not? If so, how can that be? And how can it be that lying to someone is immoral (...) when other, harsher ways of treating her are permissible? The essay examines several responses to the first question, and suggests that lying violates morality as an excessive departure from the role-derived virtues of charity and justice: the liar wills another person the evil of false belief precisely in the proposition for which the speaker offers her assurance and takes special responsibility in asserting. So conceived, lying is an especially egregious form of treachery and degrading manipulation of another person. Appeal is then made to the gravity inherent in lying so conceived to suggest ways of answering the other questions which would support the traditional Augustinian claim that lying is inherently impermissible and ineligible in circumstances where other forms of deliberate deception may not be, and even in situations where violent attack may be permissible.At the end, a taxonomy of more and less rigorist positions of lying is offered. A tentative proposal is made that, while consistent with the traditional Augustinian rigorist position that Iving is always immoral, nevertheless has some features that may slightly soften that view’s practical application. The proposed view does this in a way similar to that in which allowing moral dilemmas may soften it, for allowing dilemmas means there may be cases where an act of a type always immoral may still be more eligible than any alternative. However, it is maintained that the view here proposed need not countenance genuine dilemmas. (shrink)

I here respond to several points in Faucher and Machery’s vigorous and informative critique of my volitional account of racism (VAR). First, although the authors deem it a form of "implicit racial bias," a mere tendency to associate black people with "negative" concepts falls short of racial "bias" or prejudice in the relevant sense. Second, such an associative disposition need not even be morally objectionable. Third, even for more substantial forms of implicit racial bias such as race-based fear or disgust, (...) Faucher and Machery offer no account or explanation of when we should consider these racist, in whom, in what respect(s), or why. So, findings of implicit racial bias pose no clear objection to VAR. Fourth, because VAR allows not only racial hate, but also callous indifference, disdain, and other forms of racially driven disregard, to be racist,VAR is not "psychologically monist." Fifth, as VAR allows racist attitudes to be immoral in more than one way, offending against both the moral virtues of benevolence and justice, VAR is not "morally monist" either. I also reveal problems with some of Faucher and Machery’s other claims: Faucher and Machery take too narrow a conception of the types of psychology that can contribute to understanding racism; the internal complexity of hatred, which they approvingly mention, is irrelevant to VAR’s truth and undermines part of their criticism of VAR; whether some forms of racial bias are "racial ills" is irrelevant to VAR, which only analyzes racism; over-attention to implicit racial bias may cloak or exacerbate some of our society’s racial ills, or even constitute a new one. I conclude by noting that Faucher and Machery are not just critics of VAR but also allies of VAR in important controversies against those who insist racism lies primarily in social structures and institutions. This paper addresses two related questions. First, what is involved in giving a distinctively realist and naturalist construal of an area of discourse, that is, in so much as stating a distinctively realist and naturalist position about, for example, content or value? I defend a condition that guarantees the realism and naturalism of any position satisfying it, at least in the case of positions on content, but perhaps in other cases as well. Second, what sorts of considerations render a distinctively (...) realist and naturalist position more plausible than its irrealist and non-naturalist rivals? The answer here focuses again on theories of content and is wholly negative. I argue that the standard array of arguments offered in support of realist and naturalist theories in fact provide equal support for a host of irrealist and non-naturalist ones. Taken together, these considerations reveal an important gap in the recent philosophical literature on content. The challenge to proponents of putatively realist and naturalist theories is to insure that those theories so much as state distinctively realist and naturalist positions and then to identify arguments that support what is distinctively realist and naturalist about them. Recent challenges to Kratzer’s canonical contextualist semantics for modal expressions are united by a shared methodological practice: Each requires the assessment of the truth or warrant of a sentence in a scenario. The default evidential status accorded these judgments is a constraining one: It is assumed that, to be plausible, a semantic hypothesis must vindicate the reported judgments. Fully assessing the extent to which these cases do generate data that puts pressure on the canonical semantics, then, requires an understanding of (...) this methodological practice. Here I argue that not all assessments are fit to play this evidential role. To play it, we need reason to think that speakers’ assessments can be reasonably expected to be reliable. Minimally, having such grounds requires that assessments are given against the background of non-defectively characterized points of evaluation. Assessing MacFarlane’s central challenge case to contextualism about deontic modals in light of this constraint shows that his judgments do not have the needed evidential significance. In addition, new experimental data shows that once the needed scenario is characterized non-defectively, none of the resulting range of cases provides data that cannot be accommodated by a Kratzer-style contextualism. This paper raises serious problems for the commonly held claim that races are socially constructed. The first section sketches out an approach to our construction of institutional phenomena that, taking Searle’s general approach, restricts social construction proper to cases where we adopt rules that bind relevant parties to treat things of a type in certain ways, thus constituting important roles in, and parts of, our social lives. I argue this conception, construction-by-rules, helps distinguish genuine construction from other activities and relations (...) and also solves a problem raised against simplistic conceptions. The second shows why and how Sally Haslanger, Linda Alcoff, and Glenn Loury have explained race as a social construct. The next points out problems for their and other accounts, including circularity, difficulties arising from conceptual and linguistic history, and non sequiturs. After returning to Haslanger in more detail, I proceed critically to engage work by Ian Hacking, Lawrence Blum, Luc Faucher and Edouard Machery, and Charles Mills. The following sections move from specific accounts in the literature to offer general arguments that viewing races as products of social construction threatens to mislead in numerous ways. At the end, I discuss the significance of the issue and challenge whether social constructionist accounts are genuinely liberating. (shrink)

One of the strangest of the many strange habits of philosophers, which mark them out as the Ishmaels of the scientific world, is their refusal to agree as to the precise meaning of the words they use. No philosopher, it seems, is bound by the definitions given by predecessors or contemporaries of even the most central terms: each has to define his terms for himself. The resulting situation certainly lends itself to ridicule and caricature, as in the legend of the (...) theological disputants who arrived after long argument at the conclusion that when the one said ‘God’ he meant what the other meant when he said ‘Devil.’ Still it is probable that this idiosyncrasy of philosophers has some real ground in the special nature of the task on which they are engaged, and is not a mere exhibition of aimless malice or sheer incompetence. Whether that is so or not, one of the consequences of this situation is that the titles of philosophic discourses are apt to be singularly unilluminating: as an indication of the problem to be raised they are, to say the least, highly ambiguous. How the reader may understand the title of this paper I do not know; but the question which I had in mind in choosing it was this. (shrink)

At the start of her vigorously argued and classic article, “Modern Moral Philosophy,” G. E. M. Anscombe stated three focal theses. First, that philosophers of the time needed to dispense with investigation into talk of what is morally right, wrong; permissible, forbidden, required; and of moral obligation or duty, what we morally ought to do. Second, there was no adequate philosophical psychology then available of the sort needed for doing good moral philosophy. Third, the differences among the modernist moral philosophers (...) that had been most widely discussed were not as important as what they agreed on. I wish here to make some remarks about the sequel. More specifically, I will briefly discuss some aspects of how things have since played out with the first two theses, in order to say something about the relation between the first and second theses and about the state of things with respect to her third thesis, especially as it impacts today's medical ethics, a field of inquiry that barely existed at the time Anscombe wrote “Modern Moral Philosophy.&rdquo.
